Estate Planning & Strategies

Thoughts of estate planning often bring more questions than answers: Could an heir be too young to inherit? Should the inheritance be given at a certain age? Is the intended beneficiary in a shaky marriage with divorce as a possibility? Are there children from a previous marriage? Should inheritance be protected from potential creditors of the heir? Are there taxes that can be avoided? Are you able to avoid the probate court rules, delays, and costs?

Planning what happens to your estate when you’re gone can seem frustrating and intimidating without qualified help. You may feel that you’re too young to care about estate planning. Or, perhaps the reminder of death makes you uncomfortable. You might be tempted to put the whole thing off, assuming that it will just take care of itself. Estate Planning FAQs

Am I too young for estate planning?

You may feel that you’re too young to care about estate planning, or the reminder of death may make you uncomfortable. In all cases, estate planning ends up saving your family lots of time, heartache and money. If you have children, property, or a business, the plan matters now.

Does Florida have an estate or inheritance tax?

Florida imposes no state estate tax and no inheritance tax. Federal estate tax still applies above the federal exemption, and estates with property in other states can face tax there. Probate in Florida also carries its own rules, delays and costs — which is often the more immediate planning issue for families here.

Do you replace my attorney?

No. We help you organize and create your estate planning team — experts on law, finance and taxes — and we work alongside your attorney rather than in place of one. Our role covers the financial and tax side: evaluating and recommending options, reviewing documents, lessening taxes at time of death, and preparing for estate and trust tax problems.

What happens if I become incapacitated?

Arranging for management of your estate in the event you are incapacitated is part of the plan, alongside health care directives and power of attorney. It is the piece most often left undone, and the one families most often need first.
